You may use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Copy, modify, or distribute any part of the Service without our written consent.
• Use the Service to upload, transmit, or distribute harmful or illegal content.
• Attempt to gain unauthorized access to the Service or interfere with its operation.

Some features of the Service require creating an account, while others can be used without registration.

If you choose to create an account, you agree to:

• Be responsible for all activities under your account.

• The App uses artificial intelligence to analyze user movement through the device's camera in real time.
• The camera feed is processed locally or in the cloud solely for motion analysis.
• No video or image data is recorded, stored, or shared.
• The AI feature provides general fitness guidance only and is not a medical or therapeutic tool.
• You use the AI motion analysis at your own discretion and risk. FrumuseteAI, LLC is not liable for injuries or issues arising from incorrect exercise performance or device positioning.

Before starting any fitness program, consult your physician or healthcare provider, especially if you have pre-existing conditions, injuries, or other health concerns.

• You acknowledge that physical activity carries inherent risks.
• FrumuseteAI, LLC is not responsible for any injuries, health problems, or damages that may result from using the App, performing exercises, or following guidance provided within the Service.
• By using the App, you confirm that you participate voluntarily and assume full responsibility for your physical condition and actions.

All content, text, graphics, logos, design elements, videos, software, and other materials provided through the Service are the exclusive property of FrumuseteAI, LLC, a Delaware limited liability company, or its licensors.

• You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for personal, non-commercial purposes only.
• Any unauthorized copying, distribution, modification, or commercial use of the content is strictly prohibited.

• Certain features may require payment or a subscription. All payments are processed securely via third-party providers such as Apple or Google.
• All fees are non-refundable except as required by applicable U.S. law or App Store / Google Play refund policies.

• The Service and its content are provided "as is" and "as available," without warranties of any kind, express or implied.
• To the fullest extent permitted by law, FrumuseteAI, LLC disclaims all liability for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Service, including but not limited to loss of data, device malfunction, or physical injury during workouts.

Your privacy is governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Service, you consent to such processing.

We may suspend or terminate access to the Service at any time without prior notice if you violate these Terms or engage in harmful or unauthorized activity.

• These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law rules.
• Any legal actions or proceedings shall be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

Mandatory Arbitration:

• Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration under the Federal Arbitration Act (FAA) and administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
• The arbitration shall be conducted in English, in the State of Delaware, unless both parties agree otherwise.

Waiver of Jury Trial:

• You and FrumuseteAI, LLC waive any right to a trial by jury in any dispute.

Class Action Waiver:

• You agree that disputes will be resolved only on an individual basis and that no claim may be brought as a class action, consolidated, or representative proceeding.

Exceptions:

• Either party may bring claims in small claims court or seek injunctive relief for intellectual property infringement without engaging in arbitration first.
